Allied Waste Services agrees to furnish the collection and disposal services and equipment specified herein and Customer agrees to the following terms and conditions:

Service: Price is for delivery of the debris box noted on the reverse side, its use for 6 calendar days, and its removal at the end of the 7-day period. Disposal is included. A 5-day temporary bin is charged as a 1-haul collection fee (pre-paid) plus a delivery fee. After 7 days, a demurrage (rental) fee of half of the regular haul rate will be charged. A minimum charge of 2 hauls will be applied to accounts having less than 2 collections in a 30-day period.
Material: The material to be collected and disposed of by Allied Waste, pursuant to this Agreement, is solid waste or recycling generated by Customer excluding radioactive, volatile, highly flammable, explosive, toxic or hazardous material. Allied Waste shall acquire title to the material when it is loaded onto Allied Waste trucks. Title to and liability for any waste excluded above shall remain with Customer and Customer expressly agrees to defend, indemnify and hold harmless Allied Waste from and against any and all damages, penalties, fines and liabilities resulting from or arising out of such waste excluded above.
Liability for equipment: Customer acknowledges that it has the care, custody and control of equipment owned by Allied Waste and accepts responsibility for the equipment and its contents except when it is being physically handled by employees of Allied Waste. Therefore, Customer expressly agrees to defend, indemnify and hold harmless Allied Waste from and against any and all claims for loss of or damage to property, or injury to or death of person or persons, resulting from or arising in any manner out of Customer’s use, operation or possession of any equipment furnished under this Agreement.
Damage to Pavement: Customer acknowledges that Allied Waste shall not be liable for any damages to pavement or driving surfaces resulting from its equipment in the course of delivery or removal. NOTE: Customer agrees that Allied Waste shall not be liable for any damages for requests of bin to be placed on lawn.
Terms: Original term is for 7 days, but may be extended by mutual agreement of the parties without necessity of another written Agreement.
Rates: Rates are subject to change upon 5 days notice.
